As of 2006, the Department of Labor identified maximum fees that attorneys are able to charge in relation to legal services for workers compensation cases. Although not every state has such maximums, the vast majority of states do provide mandates.
In some states, attorneys fees are included as part of the case award, however there are instances where it has not been expressly stated where the funds are to be derived. The majority of states allow attorneys to charge between 20% and 30% of the amount collected in the award, however, some states have no provision for maximums at all.
